各省、自治區、直轄市自然資源主管部門、農業農村（農牧）廳（局、委），新疆生產建設兵團自然資源局、農業農村局：
近年來，一些地方農村未經批準違法亂占耕地建房問題突出且呈蔓延勢頭，尤其是強占多占、非法出售等惡意占地建房（包括住宅類、管理類、工商業類等各種房屋）行為，觸碰了耕地保護紅線，威脅國家糧食安全。習近平總書記等中央領導同志高度重視，多次作出重要指示批示。為貫徹落實中央領導重要指示批示精神，堅決遏制農村亂占耕地建房，現就農村建房行為進一步明確“八不準”。通知如下：

一、不準占用永久基本農田建房。

二、不準強占多占耕地建房。

三、不準買賣、流轉耕地違法建房。

四、不準在承包耕地上違法建房。

五、不準巧立名目違法占用耕地建房。

六、不準違反“一戶一宅”規定占用耕地建房。

七、不準非法出售占用耕地建的房屋。

八、不準違法審批占用耕地建房。

各地要深刻認識耕地保護的極端重要性，向社會廣泛公告、宣傳“八不準”相關規定。地方各級自然資源、農業農村主管部門要在黨委和政府的領導下，完善土地執法監管體制機制，加強與紀檢監察、法院、檢察院和公安機關的協作配合，形成合力，采取多種措施合力強化日常監管，務必堅決遏制新增農村亂占耕地建房行為。對通知下發后出現的新增違法違規行為，各地要以“零容忍”的態度依法嚴肅處理，該拆除的要拆除，該沒收的要沒收，該復耕的要限期恢復耕種條件，該追究責任的要追究責任，做到“早發現、早制止、嚴查處”，嚴肅追究監管不力、失職瀆職、不作為、亂作為問題，堅決守住耕地保護紅線。

各省、自治區、直轄市自然資源主管部門、農業農村（農牧）廳（局、委），新疆生產建設兵團自然資源局、農業農村局：
為貫徹落實黨中央、國務院決策部署，保障農村村民住宅建設合理用地，針對當前存在的計劃指標需求不平衡、指標使用要求不夠明確、指標有挪用等問題，現通知如下：
一、計劃指標單列。各省級自然資源主管部門會同農業農村主管部門，每年要以縣域為單位，提出需要保障的農村村民住宅建設用地計劃指標需求，經省級政府審核后報自然資源部。自然資源部征求農業農村部意見后，在年度全國土地利用計劃中單列安排，原則上不低于新增建設用地計劃指標的5%，專項保障農村村民住宅建設用地，年底實報實銷。當年保障不足的，下一年度優先保障。
二、改進農村村民住宅用地的農轉用審批。對農村村民住宅建設占用農用地的，在下達指標范圍內，各省級政府可將《土地管理法》規定權限內的農用地轉用審批事項，委托縣級政府批準。
三、加強規劃管控。在縣、鄉級國土空間規劃和村莊規劃中，要為農村村民住宅建設用地預留空間。已有村莊規劃的，要嚴格落實。沒有村莊規劃的，要統籌考慮宅基地規模和布局，與未來規劃做好銜接。要優先利用村內空閑地，盡量少占耕地。
四、統一落實耕地占補平衡。對農村村民住宅建設占用耕地的，縣級自然資源主管部門要通過儲備補充耕地指標、實施土地整治補充耕地等多種途徑統一落實占補平衡，不得收取耕地開墾費?？h域范圍確實無法落實占補平衡的，可按規定在市域或省域范圍內落實。
五、嚴格遵守相關規定。農村村民住宅建設要依法落實“一戶一宅”要求，嚴格執行各?。ㄗ灾螀^、直轄市）規定的宅基地標準，不得隨意改變。注意分戶的合理性，做好與戶籍管理的銜接，不得設立互為前置的申請條件。人均土地少、不能保障一戶擁有一處宅基地的地區，可以按照《土地管理法》采取措施，保障戶有所居。充分尊重農民意愿，不提倡、不鼓勵在城市和集鎮規劃區外拆并村莊、建設大規模農民集中居住區，不得強制農民搬遷和上樓居住。宅基地審批要嚴格落實《農業農村部 自然資源部關于規范農村宅基地審批管理的通知》（農經發〔2019〕6號）。
各省級自然資源、農業農村主管部門要結合實際制訂實施細則。
